Abstract (en)
The subject matter of this doctoral dissertation is protection against
discrimination in the field of labor and employment, viewed from a
legal perspective and the perspective of neo-institutional economic
analysis of law. The aim of the research is to examine the
efficiency and effectiveness of the application of legal and
economic mechanisms aimed at combating discrimination in the
labor market and improving the protection of the rights of
discriminated persons.
The theoretical part of the dissertation analyzes relevant antidiscrimination
regulations at the international, regional and
domestic levels, as well as economic models of discrimination in
the labor market, with the aim of examining the compliance of the
domestic legal framework with economic laws and contemporary
comparative law trends.
The empirical research covers the period from 2009 to 2024,
starting from the normative reforms of 2009, which instituted the
anti-discrimination framework. The research focuses on the case
law in anti-discrimination litigation, the practice of the
Commissioner for the Protection of Equality and the Republic
Agency for the Peaceful Settlement of Labor Disputes, relevant
statistical data, as well as data collected by using standard scientific
methods (online questionnaire, semi-structured interviews, and
focus groups). Special attention is given to the position of women,
members of the Roma national minority, the LGBTIQ+ population
and persons with disabilities, as groups that traditionally sustain at
greater risk of discrimination.
The research results allow for assessing the scope of existing legal
protection mechanisms, identifying their structural limitations in
practice, and formulating recommendations for improving the
normative and institutional framework. The scientific contribution
of the dissertation is reflected in the integration of legal and neoinstitutional
economic analysis in the assessment of antidiscrimination
policy, as well as in the empirical verification of the
effects of its implementation over a longer period of time.
