Abstract (en)
The research of violence against children in this paper is focused on two main areas of interest: the phenomenology of crime and criminal etiology. The main objective of this research is to collect statistical data about phenomenological and etiological characteristics of violence against children, with a special emphasis on the main groups of criminal acts which involve children as victims of violence and abuse.
The theoretical part of the paper is focused on synthesizing the observed available scientific discoveries related to the forms of violence against children, the scope and prevalence of violence against children, its consequences, etiology, as well as the activities of crime prevention taken by different systems – educational, legal or medical institutions, social services and nongovernmental organizations – directed towards protecting children’s rights and interests. The empirical research is aiming to determine the forms of violence against children and their distribution in the defined research sample. In the final discussion, the theoretical findings and conclusions are synthesized and crossed with immediate empirical data in order to identify the deficiencies in the solutions provided by positive law, and recognize the possible improvements and recommendations to enhance the position of children in the family, and in the society, and subsequently to provide a comprehensive protection of children’s rights in the society. Methodology used in the theoretical part of the paper is the following: linguistic normative method, formal-dogmatic approach, historical method, comparative method, comparative legal method, axiological approach, sociological method, logical method, analysis and synthesis. In the empirical research, we used the methods of indirect observation and content analysis, particularly the analysis of criminal cases that included criminal proceedings for criminal acts involving child victims and the analysis of final judgements given by the Basic court and the Higher Court in Niš from 2006 to 2018.
Timely and effective child protection from violence demands further alignment of national legislation and continuous application of ratified international documents, as well as good coordination of institutions anda comprehensive influence on rigid cultural patterns, social awareness and appropriate education of both individuals and the society itself.
