Abstract (en)
The first part of dissertation, comprises the introductory sections, the theoretical
and methodological framework, consideration of the topic, determining the object of research and
operationalization of all phases of research, including the scientific and practical contribution.
The central part of the work is the presentation and analysis of legal history since the first acts
of terrorism coinciding with the state's very creation. Two basic forms of terrorism crystallized:
terror of the government and terror against the government. The first consists of ruling through the
use of violence, by turning terrorism into a political system and ruling politics. Another form of
terrorism is terror against the government, which is of specific interest to this study because it
includes hijacking an aircraft as a special form of a terrorist act. It attacks the ruling institutions
and power holders, including endangering, destabilizing, or destroying the country's political
structure. These acts leave the impression that they are based on illegitimate violence, that they
are a tool of the minority, that they affect the innocent, and that they are exclusively aimed at
causing intense fear and insecurity. This form of terrorism in history was primarily manifested as
a terrorist act with a political direction aimed at fighting for power, but also fighting against
tyranny and with certain admixtures of serving appropriate political ideologies of different
character. It most often manifested itself in the form of assassinations and physical liquidation of
representatives of the ruling class or regime in order to achieve political goals or at least
concessions. History teaches us that this kind of terrorism was often accompanied by destructive
demonstrations against certain objects that held symbolic importance. Later, other forms of
terrorism appear, more organized and collectively implemented, which follow the entire political
history all over the world, regardless of the existence or non-existence of political programs of the
terrorist group, or the diversity of their ideological character. In recent historical periods, terrorism
is rapidly developing and changing, as it acquires specific characteristics with the development of
technique and technology. It is presented in social groups that fight for power within a sovereign

state as well as by states that have unrealized political and territorial pretensions themselves, as
progressive and even revolutionary. Our criminal legislation during the Cold War period, i.e., the
criminal legislation of the SFRY, of which the Republic of Serbia was a federated part, contains
many regulations for the suppression and punishment of terrorist acts, among which is the
hijacking of an aircraft as a special form of terrorism, which was codified as a characteristic form
of terrorism for the aforementioned historical period. The work is aimed at discovering the
important causes of terrorism that have crystallized throughout history with the proposal of legal
solutions that will help individual states and international organizations to, in an organized manner,
oppose all the causes and behaviors that are causally related to terrorism, in order to contribute to
the general action to combat terrorist acts and improving the safety of air traffic and passengers.
The final part of the thesis includes the verification of research results with the analysis of social
consequences, including a view from a historical distance, discussion, and final considerations
from which universal conclusions emerge.
